The Special CBI court (Vyapam Cases) Gwalior sentenced Ashutosh Gupta (accused candidate) and Pankaj Gupta @ Chimman (accused middleman) to 4 years’ RI with a fine of Rs.13,100 each in the Pre-PG Examination 2009 conducted by Vyapam (M.P.)
Central Bueau of Investigation (CBI) had registered the instant case on 13.08.2015 in compliance to the orders of Hon’ble Court of India by taking over the FIR No. 97/15 dated 21.03.2015 registered by MP Police (PS Jhansi Road, Gwalior) against Ashutosh Gupta, Pankaj Gupta @ Chimman and others.
It was alleged that Ashutosh Gupta had arranged a solver through Pankaj Gupta for a consideration of Rs 15 lakh (approx.) for the Pre PG-Exam 2009. Local Police had filed 2 Charge Sheets/supplementary charge sheet.
During the CBI Investigation, opinion on the handwritings/signatures of the accused persons were obtained from CFSL.
CFSL Expert Opinion had established that accused candidate Ashutosh Gupta had not appeared in the said examination conducted by Vyapam on 12/04/2009 at Jabalpur, MP.
During CBI investigation it was also found that the accused Ashutosh Gupta was on duty as Medical Officer at the Primary Health Centre Kariyawati, Gwalior on Saturday and Monday (the exam was on intervening Sunday on 12/04/2009) and he had not sought any permission/station leave permission for visiting Jabalpur to appear in the said Examination.
Further, investigation revealed that candidate Ashutosh Gupta had contacted middleman Pankaj Gupta who had arranged solver for Sh. Ashutosh Gupta in the said Pre-PG 2009 Examination for a consideration of 15 lakh (approx). Ashutosh Gupta paid the same to Pankaj Gupta after getting admission in the Gajra Raja Medical College.
After completion of investigation, CBI filed a supplementary chargesheet on 05.01.2018 against accused with additional evidences collected during its investigation .
Trial Court found the accused guilty and sentenced them accordingly.
