The Madhya Pradesh High Court has served notice on a PIL challenging the Nagar Palika Parishad Bina order imposed ban on sale of meat, fish, eggs and related products during Ganesh Mahotsav celebration violates the fundamental rights provisions of the Constitution of India.

The petitioner’s counsel submitted that the order dated 07.09.2024 passed by the Chief Municipal Officer, Bina whereby he imposed a ban on the sale of meat, fish, eggs and related products during Ganesh Mahotshav Celebration, is arbitrary, discriminatory and violates the fundamental rights under Articles 14, 19(1)(g) and 21 of the Constitution of India.

A division bench of Chief Justice SK Kait and Vivek Jain heard the PIL and observed that on perusal of the said order this Court finds that the effect of the same was up to 17.09.2024.

The petitioner’s counsel submitted that the present writ petition was filed on 13.09.2024, but was not listed before the Court by the Registry due to some defects or otherwise.

However, if this petition is not considered then the impugned order will be a precedent for coming years to come, the counsel said.

The court also served notices on the State government and the district collector Sagar during hearing of the petition.

Rejoinder thereto, if any, within 2 weeks thereafter. Renotify after five weeks.
