Madhya Pradesh High Court a principal seat at Jabalpur has directed the State Election Commission (SEC) to decide the representation of a petitioner related to recounting of votes of polling booth number 46 of Gram Panchayat Tikaria, Block Vijayraghavgarh, Katni district by July 14, 2022.
Further the court directed the SEC to decide the petitioner’s representation through a speaking order and if need be take appropriate disciplinary action against the delinquent officer under intimation to this court.
Justice Vivek Agrawal directed the SEC that “if for some reasons petitioner’s representation is not decided then for the constituency Gram Panchayat Tikaria, block Vijayraghavgarh, Katni District result will not be filalized on 14.07.2022 by the Returning Officer.”
The court order said in the opinion of this Court, it (application) is decided arbitrary, and therefore, petitioner has been able to prima facie make out a case for indulgence as stage of sub-rule (5) of Rule 80 was yet not over when application was made in the facts and circumstances of the case.
Jitendra Patel, a petitioner is a farmer moved the high court was aggrieved over the Presiding officer of booth number 46 rejected his application for recounting of votes. The petitioners counsel furnished document that contained over-writing at two places, besides other inaccuracies that the Presiding Officer was not acting fairly.
