The Madhya Pradesh High Court directed the state Director General of Police to suspend the Chhindwara superintendent of police (SP for not taking seriously the high court order to execute non-bailable warrant against respondent no. 3 – NHAI director project implementation unit D Anil Kumar.
Te court issued the direction during hearing of a contempt petition filed by the social organisation Tulsi Ramayan Sankirtan Mandal of Chhindwara for not paying the compensation amount for 618 square feet land of total 1254 square feet land was acquired for the road construction by the NHAI, the petitioner’s counsel VP Nema said.
While the social organisation has received compensation for 636 square feet but is waiting for compensation for remaining portion of land acquired for road construction from bus stand to char pathak road in district headquarters, the counsel said.
A division bench of Chief Justice Ravi Malimath and Justice Vishal Mishra said ‘Under these circumstances, when the Superintendent of Police, Chhindwara himself is unable to execute the order of this Court, the nonbailable warrant is directed to be executed through the Director General of Police, Madhya Pradesh’.
The court order said by order dated 28.03.2023, a non-bailable warrant was issued against the respondent No.3 (NHAI director project implementation unit D Anil Kumar) through the Superintendent of Police, Chhindwara, returnable by 12.04.2023.
A letter has been written by the Superintendent of Police, Chhindwara to the Registrar (J-II) of this Court wherein he has stated that the respondent No.3 (NHAI director project implementation unit D Anil Kumar) has been transferred, therefore, the warrant could not be executed, the court order said.
“We are indeed shocked with the letter of the Superintendent of Police, Chhindwara, the court observed.
The only reason has been assigned that the respondent No.3 has been transferred, the court further said.
‘Where he is transferred and why the non-bailable warrant could not be executed, has not been stated by him. This is not acceptable. It would appear that our orders are not being taken seriously. Even the Government Advocate is not aware of the same’, the court order said.
Thus, the Director General of Police, Madhya Pradesh is directed to place him under suspension forthwith pending further orders of this Court, the court order said.
Hence, issue non-bailable warrant against the respondent No.3 through the Director General of Police, Madhya Pradesh, returnable by 19.04.2023, the court order said.
