Madhya Pradesh High Court giving interim relief to a bus operator of Betul district has allowed to ply bus between Bainsdehi (MP) to Nagpur (Maharashtra) as per rules and shall not be stopped on ground of non counter signature of State of Maharashtra on the temporary permit issued by Madhya Pradesh Tranport Department.
As per reciprocal agreement dated 01-03-2007 executed between Madhya Pradesh and Maharashtra, both would respect reciprocal agreement/temporary permit given for plying vehicles between two States, therefore it is mandatory that any permit to ply vehicles between two states must carry counter signature of the transport authorities of both the states.
In case of the petitioner bus operator Sharad Wagadre of Betul, he was facing difficulty to ply the buses between two states as there was no counter signature of Maharashtra transport authority on the temporary permit issued to him.
This has hindered the right to pursue business/occupation, as enshrined under Article 19 of Constitution, the petitioner claimed.
Justice SA Dharmadhikari ordered as an interim arrangement, petitioner shall be allowed to ply his vehicle in accordance with the terms and conditions of permit and the said vehicle shall not be stopped on the ground of non counter signature of State of Maharashtra over the temporary permit granted to the petitioner, the court order said.
The court directed the State of Maharashtra to consider the case of petitioner as per terms and conditions of reciprocal agreement dated 01.03.2007 and if petitioners fulfill all the conditions, then counter signature be made immediately within 7 days from the date of receipt of certified copy of the order so that petitioners if fulfill all the conditions may ply the vehicle between two destinations as referred above and their right to pursue business/occupation, as enshrined under Article 19 of Constitution of India would not be hindered in any manner, the court order said.
