The Madhya Pradesh High Court has directed the state government consider the grievance of Bhopal Additional Commissioner of Police (Habibganj) Virendra Kumar Mishra relating to benefits and seniority of out of turn promotion given to him on May 31, 2005.
Mishra was given out of turn promotion for arrested 8 dacoits during his posting in Belkheda police station, Jabalpur, thereafter the State government gave out of turn promotion by elevating him from post of sub inspector to inspector on May 31, 2005, advocate Pankaj Dubey appeared for Mishra said.
The police officer moved the high court after the police headquarters and the administration did not executed the state government order of grant of out of turn promotion therefore he did not get the seniority and other benefits, the counsel said.
The out of turn promotion was given to the petitioner police officer under provisions of Regulation 70-A of the MP Police Regulations, the counsel said.
The petitioner’s counsel submitted despite passing the order and approving by the State Government for grant of out of turn promotion to the petitioner, the same has not been given effect by the police authorities so far.
The petitioner’s counsel submitted the petitioner was again granted out of turn promotion vide order dated 18.09.2007 for arrested the naxalites.
He submits that till date the respondents have not denied to give effect to the order dated 31.05.2005.
Justice Sanjay Dwivedi directed the State of Madhya Pradesh and the Director General of Police to consider the grievance of the petitioner and pass appropriate order in accordance with law within a period of 30 days.
The court order said “if there is no other impediment in granting benefit of the order dated 31.05.2005…., the same may be granted to the petitioner”.
“It is further made clear that while taking decision on the order passed by the State Government, the request of the petitioner shall not be rejected on the ground that at present there is no provision of granting out of turn promotion in the Police Department in view of the provisions of Regulation 70-A of the Regulations”, the court order said.
“The respondents shall consider the grievance of the petitioner in accordance with law”, the court order said.
With this directions the court disposed of the petition.
