The Ministry of Home Affairs argued in the Lok Sabha on Tuesday that illegal Rohingya migrants represent a threat to national security.

“Illegal migrants (particularly Rohingyas) are a national security danger. According to reports, some Rohingya migrants are engaging in unlawful activities “In a written response, Union Minister of State for Home Nityanand Rai remarked.

A writ case has been filed in the Supreme Court, requesting that Rohingya migrants not be deported from India, according to the ministry.

“The Supreme Court is now hearing the case. The court, however, has not issued a stay on the deportation of the Rohingyas “he stated

Mr. Rai stated that India is neither a signatory to the 1951 United Nations Convention on the Status of Refugees or its 1967 Protocol. The provisions of The Foreigners Act, 1946, The Registration of Foreigners Act, 1939, The Passport (Entry into India) Act, 1920, and The Citizenship Act, 1955, as well as rules and orders made thereunder, apply to all foreign nationals, including refugees.

“Foreign nationals who enter into the country without valid travel documents or whose travel documents expire while staying in India are treated as illegal migrants and are dealt with as per the existing legal provisions,” the minister added.
