New Delhi: On the issue of cancellation of membership of 20 MLAs in the matter of profit, senior Aam Aadmi Party leader and Delhi government minister Gopal Rai said that they will approach the Supreme Court against this decision. He said that in this case he was expecting justice from the President. The party also took the time to meet the President. He alleged that the President did not give him the chance to talk to him.

Notification of Law Ministry
On Saturday, the EC had written a letter to the President recommending abolishing membership of 20 MLAs of the Delhi Government regarding the benefits of the post. The President has disqualified the Aam Aadmi Party’s 20 MLAs in the case of profit on last Sunday. The Union Law Ministry has issued notification of disqualification of these MLAs.

The Election Commission had recommended to the President that 21 legislators from Aam Aadmi Party had held the post of profit from March 13, 2015 to September 8, 2016. The Aam Aadmi Party had appointed its 21 legislators as parliamentary secretaries in various ministries of Delhi Government. One of the 21 legislators had resigned from their post, hence the decision of the Election Commission applies to 20 MLAs.

Why membership was canceled
After the formation of Aam Aadmi Party’s 67 seats in the Delhi Assembly elections in February 2015, Arvind Kejriwal had made the party’s 6 MLAs ministers. A few days later, the CM made 21 legislators as parliamentary secretaries in various ministries of the Delhi Government. This year, the Election Commission had started hearing a petition filed against the Aam Aadmi Party’s 21 legislators for making parliamentary secretary. During the hearing, one of the 21 MLAs from the Aam Aadmi Party, Jarnail Singh (Rajouri Garden) resigned. Therefore, the case against them was over.

The case was running against 20 MLAs. Now, when the Election Commission has completed its hearing in this matter, it has heard its decision. These MLAs can appeal in the High Court against the decision of the Commission. However, the party legislators who challenged this move of the Election Commission challenging the Delhi High Court did not get any relief from the court.

No immediate threat to the government
With this development Delhi has no immediate threat to the government because it has 66 MLAs in the 70-member assembly. Despite this, the BJP and the Congress had demanded the resignation of Chief Minister Arvind Kejriwal on a moral basis. In a sharp reaction on the recommendation of the Election Commission, you had claimed that the Chief Election Commissioner was trying to destabilize the government on the behest of the Prime Minister. While challenging the recommendation of the Election Commission, seven of these MLAs had approached the Delhi High Court, but the bench of Justice Rekha Palli refused to order any order on their petition.
