The Central Bureau of Investigation (CBI) has arrested Central GST, Central Excise & Customs Commissioner (Appeals) Raju Shaktivel, IRS, Guwahati and a middleman Mahavir Jain (private person) in an alleged bribery of Rs. 3.83 lakh.
A case was registered against the Commissioner (Appeals), Central GST & CE, Guwahati and three middlemen on a complaint.
It was alleged that the complainant executed construction work related to N.F. Railway and raised bills.
The Additional Commissioner, Central Goods & Service Tax, Dibrugarh raised a demand of Service Tax amounting to Rs. 48,43,034. aggrieved with the order of Additional Commissioner, Central Goods & Service Tax, the Complainant preferred an appeal before the Commissioner (Appeals), CGST, Central Excise & Customs, Guwahati against the adjudication order. It was further alleged that during one of the hearing of the said appeal, the Commissioner demanded bribe of Rs. 4,50,000 (i.e. @ of 10% of the demand of Service Tax) through middlemen, which was further negotiated to Rs. 3.83 lakh to settle the matter.
The CBI laid a trap and caught a middleman (Private Person) while accepting bribe of Rs.3.83 lakh on behalf of said Commissioner(an IRS Officer). The said Commissioner was also caught.
Searches were conducted at the premises of accused which led to recovery of incriminating materials.
Both the arrested accused will be produced before the Competent Court.
