In the chairmanship of Chief Justice of India Deepak Mishra, the Supreme Court collegium recommended the appointment of Supreme Court Judge Indu Malhotra as the Supreme Court judge on Thursday. Indu Malhotra is thus the first woman advocate to be elected. Even so, in the history of 68 years only 6 women judges have been appointed. All these judges, promoted from the High Courts, came to the Supreme Court. Collegium also recommended the Chief Justice of the Uttarakhand High Court Kuttiyil Mathew Joseph as the judge of the Supreme Court.
After the appointment of both the above judges, there will be 27 judges in the Supreme Court. After that, only 4 vacancies will remain.
Well, let us tell you What is the merit of Supreme Court judges?
Eligibility:
- He is a citizen of India.
- He has been working as a Judge in a High Court or in two or more Courts for a minimum of 5 years.
- Or, the advocate has been staying in a High Court or Courts for 10 consecutive years.
- In the eyes of the President, there is a high degree of knowledge of law.
- On the basis of 3 points above the selection of Indu Malhotra has been done and the selection of Kuttiyil Mathew Joseph is based on the 2 points above.
What is the colonial system?
There is no provision in the Constitution regarding the process of appointment of judges in the High Courts and Supreme Courts.
So this work was initially done by the government at its discretion.
But in the 1990s, the Supreme Court started intervening in this matter and gave legal regulations after one. In the light of these arrangements, gradually a new system of appointment came up in front of them, under which the concept of collegium was introduced for the appointment of judges.
These colleges are at the level of both state and central level. If it is the matter of the High Court, then the chief justice and 2-3 seniormost judges make collegium and if the matter is of the Supreme Court, then the Chief Justice of India and the Supreme Judge of the Supreme Court are members of the respective Collegium.
These colleges only choose a name for the appointment of the judges of the High Court and the Supreme Court and then send their recommendation to the government.
The government takes action to appoint a judge only with these names.
