Madhya Pradesh High Court has directed to implead AIIMS, Bhopal as party in a plea related to treatment of gas affected persons.

The court held considering the issue involved AIIMS, Bhopal appears to be a necessary party in the attending facts and circumstances.

The petitioner is thus directed to implead AIIMS, Bhopal as respondent No.9 for which no separate application shall be required, the court order said.

The court issued notice to AIIMS (newly added respondent no.9).

The State brought on record the MOU dated 20.01.2024
laying down the procedure governing treatment of gas victim
cancer patients at AIIMS free of cost.

Naman Nagrath, learned Amicus Curiae has expressed certain
reservations about the time consuming process prescribed in the MOU, which made delay the treatment of cancer patients Gas Relief Victims, at AIIMS, the court order said.

At its juncture Vikram Singh, appearing for the Central Government
as well as counsel for the State by referring to Clause 7 of the Part B of the
MOU assures that the Bhopal Gas Tragedy victims, who are cancer patients
shall be treated at AIIMS, irrespective of the fact whether such patients fall
within the parameters of Ayushman Bharat Scheme or not and there shall be no delay in commencement and conclusion of treatment notwithstanding pending approval of Gas Rahat Department, the court order said.

Vikram Singh, Advocate is directed by this Court to bring this order
to the knowledge of the AIIMS.

The State Government is also directed to apprise this order to various
agencies who are involved in the process of grant of approval under the MOU so that no delay takes place in the commencement, conduction and conclusion of treatment of Bhopal Gas Tragedy Victims who are cancer patients.
