The Madhya Pradesh High Court has restrained the respondents from demolition of the houses of the petitioners for purpose of construction of 6 lane road in Chuna Bhatti area of Bhopal district.
Justice Vishal Mishra directed the petitioners may submit the representation along with relevant documents within three working days from today, in turn the Collector/Committee is directed to consider and decide the same. And, for a period of ten days from today, there will be no demolition as far as properties of the petitioners are concerned, the court order said.
The court ordered under these circumstances, Collector District Bhopal is directed to constitute a Committee comprising of officers of the Public Works Department, officers of the Corporation as well as the Revenue officers and the petitioners to submit the representation to the Collector who shall forward the same to the Committee for examination regarding ownership of the petitioners with respect to the property which is proposed to be demolished.
With this direction, the eight petitioners all residents of Deepak Grah Nirman Society Chuna Bhatti Kolar Main Road Bhopal, Madhya Pradesh moved the High Court after their houses were demarcated for demolition for construction of six lane road in Bhopal but were neither served notices in this regard by the concerned department.
It is pointed that the respondents have put a mark on the property which belongs to the petitioners, the court order said.
There is neither any notice nor any acquisition proceedings drawn up by the authority and they are trying to construct a road by acquiring personal property of the petitioners, the court order said.
They have approached the authority and submitted the documents pertaining to their ownership but without looking into the documents, steps have been taken to demolish the property in question, the court order said. Attention has also been invited to the photographs filed wherein the markings put by the respondents have been shown.
It is submitted that the respondents have already demolished the adjoining properties without any notice. Under these circumstances, the petitioners are apprehending demolition of their properties on the basis of the markings which has been put by the authorities, the court order said.
